Account Creation

• You must provide accurate and complete information when creating an account
• You must be at least 16 years old to use our Service
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

Account Responsibilities

• Provide truthful information, especially regarding your age and health status for MAF calculations
• Keep your account information up to date
• Notify us immediately of any unauthorized use of your account
• Use the Service only for lawful purposes

Third-Party Service

Our Service integrates with Strava, a third-party platform. By connecting your Strava account:

• You authorize us to access your Strava activity and profile data
• You acknowledge that Strava's terms of service and privacy policy also apply
• You understand that we are not responsible for Strava's service availability or data practices
• You can revoke this access at any time through Strava's "My Apps" page

Data Processing

We process your Strava data solely to provide MAF training analysis as described in our Privacy Policy. We do not use your data for any other commercial purposes.

Not Medical Advice

IMPORTANT: Our Service provides fitness tracking and analysis tools but does NOT provide medical advice, diagnosis, or treatment recommendations.

• Consult a healthcare provider before starting any exercise program
• The MAF method calculations are for informational purposes only
• Individual health conditions may affect the appropriateness of MAF training
• Stop exercising and seek medical attention if you experience any concerning symptoms

Assumption of Risk

By using our Service, you acknowledge that:

• Physical exercise involves inherent risks
• You are voluntarily participating in activities that may involve risk of injury
• You assume full responsibility for any risks, injuries, or damages, known or unknown
• You are physically and medically able to participate in fitness activities

User Responsibility

You are solely responsible for:

• Determining whether MAF training is appropriate for your health status
• Monitoring your body's response to exercise
• Seeking professional medical or fitness advice when needed
• Following safe exercise practices

Our Rights

The AerobAce App, including its design, functionality, algorithms, and content, is protected by intellectual property laws. We retain all rights to:

• Our proprietary MAF analysis algorithms and calculations
• The app's user interface and design
• Our original content and educational materials
• Our trademarks and branding

User Content

You retain ownership of your fitness data. By using our Service, you grant us a limited license to process your data solely to provide the MAF training analysis features.

Third-Party Content

The MAF 180 Formula and related concepts are based on Dr. Phil Maffetone's work. We implement these principles with proper attribution to their original source.

Beta Software

Our Service is currently in beta testing. We make no guarantees about:

• Service uptime or availability
• Data backup or recovery
• Feature stability or consistency
• Compatibility with all devices or browsers

Modifications

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update these Terms as needed
• Add or remove features during the beta period

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Damages

In no event shall AerobAce App be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Personal injury or property damage related to exercise
• Service interruptions or data loss
• Third-party service failures (including Strava)

Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (which may be zero for free accounts).

By You

You may terminate your account at any time by:

• Deleting your account through the app settings
• Revoking access on Strava's "My Apps" page (this also deletes all your data)
• Contacting us at support@aerob-ace.com

By Us

We may terminate or suspend your account if:

• You violate these Terms
• You engage in fraudulent or harmful behavior
• We discontinue the Service
• Required by law or legal process

Effect of Termination

Upon termination:

• Your access to the Service will be immediately suspended
• Your data may be deleted according to our Privacy Policy
• These Terms will remain in effect for any outstanding obligations

Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

Dispute Resolution

For any disputes arising from these Terms or your use of the Service:

• Informal Resolution: Contact us first at support@aerob-ace.com to try to resolve the issue
• Formal Disputes: If informal resolution fails, disputes will be resolved through the courts of Berlin, Germany
• EU Residents: You retain the right to bring proceedings in your country of residence

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AerobAce App regarding the Service.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
